The Catering Services Quality and the Personnel Liability Insurance

Abstract:

Personnel liability insurance in the Russian Federation is in the forming stage. Professional liability insurance programs are primary implemented in those spheres where either creation of professional associations or activities licensing are legislatively allowed. The catering is not licensed activity in Russia, but the potential damage risks for the consumer health connected with the use of dangerous foodstuff still exist. Nevertheless, the practice of the official prosecution in catering is not broadly applied. It is caused by the economic factors: the wage level, life expectancy growth, the size of the insurance covering under insurance contracts. Nowadays, supervisory authorities call to account officials by the administrative responsibility due to the requirement violations of sanitary rules and technical regulations. Violations of the normative documents requirements in terms of money can define and actually show the personnel responsibility occurrence regarding to a property and/or physical harm resulting from the inappropriate foodstuff consumption risks. The civil liability occurrence that provides consumer protection does not exclude administrative accountability, while continuity between insured event and discrepancies to normative documents is observed. Practically, the civil liability in catering can be realized by means of official professional liability insurance. Lack of the up-todate researches on this issue slows down the implementation of the professional liability insurance program in catering. Active implementation of the voluntary insurance allows not only compensate damage but also protects economic interests of the officials working in the risky conditions of the dangerous product output.
